Need Help Father is moving to a different county. I work and will not be able to pick the children up at time stated in court order. Also can not afford to travel x hours one way to pick them up. He says to bad he will just keep the kids or the police when I don't pick them up, and charge me with child abondment I have to file paper to change custody order, but I'm not sure which paper to file. Please could really use some help here. The children have lived in Stanislaus County for x years now have school here, there lives are here. Please help I can not afford attorney. And yes I'm the same person who asked about children being able to make choices. The kids are x and x. I'm very upset so sorry about any mistakes.

Go get a temp order modifying your parenting plan until you can get an actual court date. Or to quash his move in the first place. That'll show him your not just going to lay down and cry! State that if he is moving he will need to provide transportation. Too bad more people don't have the clause added that the children are not to be moved outside of a certain area. Thank Bejeebus the attorney we paid $x to review our paperwork suggested we add that in. And that was like x years ago. I thought it was a given these days. Temp Order I have looked through all court forms and not able to find the right one. Just some more back ground We have joint legal and shared physical I'm designated as primary caretaker. He has custody every other weekend and one night a week. He is to pick up the kids for visitation at begining of weekend and I'm to pick them up at the end. As I stated it's almost x hours one way to where he is moving. I work every Sunday until x:x pm, they are to be picked up at x:x. This is a problem also because both have school on Monday's and will have to travel x hours to get home. He will not budge on this. I did make him give me x days notice which I received on Thursday, so have time to complete forms and file before he can take the kids out of this county. Just need some help filing the right forms. Order to Show Cause is one be there are more I'm sure.

Sorry, I have no idea what forms you would file. Can you afford an attorney for an hour consult? It would probably be well worth your time. Or the family court and ask if they have advocates that can answer some questions. It's worth a shot. How have you been picking them up in the past? Since pick up time is x:x and you work until x:x?

Thanks for Your Support and Thoughts I can't afford an attorney, I have look at attorneys that offer free consults in Modesto and might give one of them a . I did more searching on web and found self help center for filing forms waiting for a back now. In the past I was able to leave work to pick them up being in the same town, or my husband would pick them up, or he would bring them home. Most times he (childrens father) makes the decisions on what time they were coming home. Sometimes early sometimes late, I would always go along with it because he would have the kids and ask if they could be late. Or they would just show up early. No fighting with him because of the kids. The kids are very upset about this and don't want to go to Pleasenton on weekends. They both have lives here, sports, friends and you know kids stuff. As I said they are x and x and have requested several times to make there own choices as to where they want to be and when. the county clerk will know what form to fill out. It doesn't have to be perfect or in "legalese." Just state your facts as you did here and ask for a temporary order immediately. At the hearing, if there is one, the judge can issue a temp or even a permanent order enjoining your ex from moving so far away. In WI, I think the de facto is x miles away, which is pretty damn far, but not x hours away. Your ex sounds like a jerk.

Don't let him bully you with threats and BS. At the age your kids are at, if he wants to see them at all, he might want to consider comeing to them and spending the weekend in your area. Or at least one day. I know all too well about teenagers. I'm surprised they even talk to either one of you. Beings, when they are that age, we adults know nothing and have no idea what it's like to be a teenager. I'm glad those days are over.
