Get the court order enforced. You can't complain and enable at the same time. Take the xK Medical debt and... do three things: If your child was supposed to be covered under HIS plan, and you used HIS plan's card when the child received care... then: x. Send the bill, along with a copy of the court order to HIM and demand that HE pay it. Send it certified, signed receipt. x. Also send a certified copy of the same to the hospital's billing department. Have a cover letter that explains why HE is responsible and you are not. x. Now that you child is on your insurance, ask the courts to have him pay you the additional amount. Yu may not get it either, but it too will acrue... Now, here is the "sticky" part. As far as him NOT paying support, because he is out of work. It is tough, I know. But, honestly if you throw him in jail... How does that get you the money? At least you should be able to get out of the ER debt. That should help.... Good luck!

two things if he's under the threat of punishment (jail), it WILL motivate him to get a job. He's a grown, capable man & there are TONS of women on just this forum that are working TWO or THREE jobs just to meet ends. He CAN go find and keep one job -- NO EXCUSES! Better it affect his credit instead of yours.

honestly, if he's not working and doesn't have anything or any money in the bank, you're not going to get anything anyway. why waste the time, energy and money on attys and court to get a judgement that's not worth the paper it's printed on. for now, just focus on what YOU can do for yourself and your kids - sounds like you're doing great. once he finds a job and gets on his feet again, then go after the back cs and med bills, etc. if you can be patient enough to let it ride til he buys a house - you know his gf is going to want to get married, buy a house together, and live happily ever after sooner or later - you can put a lien on his house and get paid when he goes to sell. good luck to ya!

I have sat in child support hearings, and the an unemployed, divorced father, to report back to the court every x amount of weeks showing the progrress he made on getting a job. I don't agree that OP should be "patient enough" because she has, uh for x months wasn't it? She might also have some leverage in getting his drivers license taken away due to lack of child support.

agreed, the Court and society expects him to work -- that is the law. Provide for your kids, no slouching. I am sure his current family isn't "doing without" as much as his kids in CP house.

hey! you guys know my position on paying child support ... all deadbeat PARENTS should be locked up for the neglectful scumbags they are. I'D be under the jail if i quit feeding my kids for months or years at a time! her question was "is it worth the aggravation" to HIRE an and go to court. he's not working and not in the state. she's not going to see a thin dime - especially if she starts dragging him thru court. i have friends that are owed cs for x+ years and have done everything possible to collect and their ex's haven't spent x day in jail. x deadbeat dad racked up $x+ before they suspended his license. is it worth the expense and aggravation trying to get money from an unemployed person? no. my advice was to wait until she has a chance of actually collecting something before spending money and/or starting some huge be that's only going to make things worse and cause the kids misery.

you can get a lien on his life insurance too so, x years from now when he dies, the CS arrearages are paid up. Your court order probably says that he is ORDERED to have life insurance (to cover C.S. in case of debt.) Go read it & make sure he carries life insurance. It's about $x/month and don't tell me he can't afford that!
